The Securities and Exchange Commission (SEC) and the National Futures Association (NFA) have entered into a formal Memorandum of Understanding (MOU) to increase cooperation, coordination, and information sharing regarding matters of mutual regulatory interest.
Key Provisions of the MOU
The MOU establishes a framework for the SEC and NFA to align their oversight activities through several primary mechanisms:
Expanded Information Sharing: Staff from both organizations will exchange data regarding emerging risks, examination planning, and current financial market conditions.
Structured Communication: The agreement mandates periodic meetings between SEC and NFA staff to ensure ongoing dialogue.
Operational Objectives: The collaboration aims to promote adherence to both derivatives and securities laws while maintaining high-quality oversight.
Efficiency: A primary goal of this coordination is to minimize duplicative regulatory efforts and potential conflicts in oversight for dual-regulated entities.
Leadership Statements
SEC Chairman Paul S. Atkins stated that the MOU serves to streamline cooperation and alleviate the potential for conflicting regulatory oversight, noting that coordination should be the "norm" rather than a novel concept.
NFA President and CEO Thomas W. Sexton described the agreement as a significant milestone, emphasizing that it will support the NFA’s mission of ensuring market integrity and protecting customers.
